1. Overview
1.1 The terms of use of this website "YourTicketMarket.com" (the "Website") owned by Your Ticket Market ("YourTicketMarket") are set out below. Any purchaser or seller (each a "user") of the Website will be bound by its terms. Transactions between a user selling (the "seller") and the user buying (the "purchaser") a ticket are contracts directly between them.
1.2 YourTicketMarket may change these terms of use at any time. YourTicketMarket shall notify the user by posting a revised version of the terms of use on the Website. The revised terms of use automatically take effect.
2. Registration
2.1 Registration. The user may be required to register on the Website. To register the user will be required to provide his real name, address, phone number, and email address.
2.2 Username and Password. Following registration the user is responsible for maintaining the security of the username and password and the user is responsible for any action taken under the username or password.
2.3 Account Verification. The user will be charged a random amount up to £0.20 pence to verify the user's bank account and billing address. This is to protect users from fraudulent activities in the Website. This is a onetime activation fee and is not refundable. The user will need to enter this amount into the control panel to activate an account. The user will have a 28 days allowance to use the system until the user verifies the account.
3. Selling Tickets
3.1 Listing. The seller agrees to supply the fullest possible information about any ticket listed. The credit card or debit card details provided are security against the accuracy and completeness of the information provided, as well as against any failure to supply a ticket after a purchaser makes an offer to buy that ticket. If for any reason the ticket is not as listed or the seller is otherwise in breach of these terms and conditions, YourTicketMarket may charge 100% of the price listed for the ticket or (at its option) the costs of replacing that ticket with a similar or better one from the seller’s credit card or debit card, for example if the seller lists a ticket that does not exist, lists a counterfeit ticket or the seller lists a ticket they do not own. The credit card or debit card the user submits to YourTicketMarket must not expire before the date of the event for which the ticket is for.
3.2 VAT. The seller is responsible for determining whether VAT is chargeable on the sale of the ticket and for collecting that VAT. YourTicketMarket are responsible for VAT on commission charges.
3.3 Postage charges. YourTicketMarket will calculate postage and add it to the purchaser's shopping cart.
3.4 Seller's Fee. YourTicketMarket do not charge for listing tickets on the Website, but sellers may be charged a fee upon a successful sale of any tickets. This fee is detailed for the seller when the tickets are listed on the Website.
3.5 Commitment to Supply. By listing a ticket with YourTicketMarket, the seller is committing to supply that ticket. When a purchaser agrees to buy the ticket, the purchaser is accepting the seller’s offer, and the transaction is binding on the parties. The seller is required to send the ticket to the purchaser as soon as possible after the seller receives tickets. If, for any reason, the seller fails to deliver the relevant ticket(s) to the purchaser at least 48 hours before the relevant event, YourTicketMarket may deduct payment from the seller’s credit card or debit card, up to the amount it costs YourTicketMarket to replace the ticket for the purchaser or 100% of the price the seller listed for the ticket as well as any other expenses or charges that YourTicketMarket incur in finding a replacement ticket. YourTicketMarket also reserve the right to cancel a sale if YourTicketMarket attempts but is unable to contact the seller via email and telephone and does not receive a response from the seller within 72 hours.
3.6 Purchaser Details. Shortly after the conclusion of the purchase of a ticket, YourTicketMarket will send to the seller the purchaser's details for delivery purposes.
3.7 Payment. At the point of the purchaser’s confirmation of the transaction, YourTicketMarket charge or authorise the amount of the purchase price (plus any commission, VAT, and postal charges) on the purchaser’s payment card. Payment for the ticket will be forwarded to the seller as soon as YourTicketMarket are satisfied that the ticket was valid and the seller delivered the ticket the buyer paid for. In most cases, this will be after the event has taken place.
3.8 Event Cancellation. If an event is cancelled, the seller agrees to refund anything YourTicketMarket paid to the seller for tickets to the cancelled event.
3.9 Transferability. The seller warrants that it owns the tickets and that it is authorised to resell them.
4. Purchasing Tickets
4.1 Pricing. The purchase price of a ticket is only guaranteed following conclusion of the purchase transaction in accordance with clause 4.3 below. Ticket prices are usually set at a level which exceeds their original "face value". "Face value" displayed on the Website is entered by the seller and are sometimes approximations. YourTicketMarket does not take responsibility on the accuracy of the value. If the buyer cannot find "face value" information please contact YourTicketMarket immediately.
4.2 VAT. Ticket prices displayed on the Website are the seller’s prices and YourTicketMarket does not pay VAT on the ticket price entered by the seller. The user will be charged processing fees which will be displayed on screen, along with associated VAT, prior to the user making a binding commitment to the purchase being made.
4.3 Payment. Full payment must be received and verified by YourTicketMarket in order to guarantee that a ticket purchase transaction has occurred. Ticket prices are guaranteed only when an order is placed and payment received.
4.4 Confirmation. The purchaser will receive a confirmation email upon placing an order. If the purchaser does not receive a confirmation email YourTicketMarket is not liable to refund any further orders in the event the initial order was successful. YourTicketMarket is not responsible for any internet connection errors experienced while making an online booking.
4.5 Changes/Cancellation of Events. YourTicketMarket does not control events. Events are sometimes postponed or cancelled. It is the responsibility of the purchaser to check with the event venue or local media to ensure arrival at the correct time and on the correct date. If an event is cancelled, YourTicketMarket will refund to the purchaser the price (if any) which it recovers from the seller. YourTicketMarket will be unable to refund shipping costs.
4.6 Ticket Validity. YourTicketMarket do not investigate the terms and conditions applicable to any particular ticket.
4.7 Substitutions. Seat locations may be substituted by sellers with equal or better seat locations only.
4.8 Seating. Seats together may include seats located one row directly in front of or behind each other. In rare cases seats together may have an aisle split between them.
5. Delivery
5.1 Delivery of the Ticket. The seller should send the ticket to the purchaser as soon as possible and using any of the tracked methods provided for on the Website or by arranging the tickets to be made available at the venue. Once the ticket(s) have been sent, the seller must destroy any purchaser details. The seller agrees to provide all shipping information required in the Website; without this information, the purchaser will not be able to confirm receipt, and the seller cannot be paid for the sold ticket. Sellers are not permitted to hand-over or hand deliver tickets to purchasers.
5.2 Delivery Details.It is the purchaser's responsibility to ensure they have correctly entered all delivery details. For phone orders, it is the purchaser's responsibility to review the confirmation email ensuring all details are correct. Neither the seller nor YourTicketMarket can accept responsibility for late or non-delivery if the details entered (or in the confirmation email) are incorrect and the purchaser will be liable for full payment.
5.3 Delivery Timing. It is the seller's responsibility to ensure there is sufficient time before an event for the purchaser to receive the tickets. On rare occasions, the seller may arrange delivery by collection at the venue; this will be clear on the Website. Unless tickets are being collected at the venue, the seller must deliver the tickets to the purchaser at least 48 hours before the start of the event. If tickets do not arrive by then, YourTicketMarket reserves the right to cancel the sale and find alternative tickets for the purchaser. In such cases, the seller will not receive payment and any excess in the cost of the tickets over what was agreed with the purchaser will be charged to the seller's credit/debit card.
5.4 Delivery Failure. YourTicketMarket will not be liable to either the seller or the purchaser for refused delivery, return deliveries or lost mail.
5.5 Accuracy. Upon delivery it is the purchaser's responsibility to immediately check the tickets for accuracy. If there are any discrepancies between the tickets received and what was ordered, the purchaser must notify YourTicketMarket accordingly within 48 hours of the delivery (holidays not included). If the purchaser does not report any discrepancy before the event, YourTicketMarket will be unable to replace the tickets, and the purchaser will, by default, accept the delivered tickets as valid.
5.6 Local address. The purchaser may be an international customer or the event may be taking place outside the United Kingdom. In these circumstances YourTicketMarket may request a local resident, business, or hotel address. It is the purchaser’s responsibility to notify the local address occupants of the scheduled delivery.
6. Liability and Indemnification
6.1 Third Party Information. YourTicketMarket does not control the information provided by other users which is made available through the Website. You may find other users' information to be inaccurate or deceptive. Please use caution when using the Website and remember that there are risks of dealing with people acting under false pretences. By using this Website, the user agrees that YourTicketMarket is not responsible for the acts or omissions of other users on the Website.
6.2 Indemnity. The user agrees to indemnify YourTicketMarket against any and all damages, awards, penalties, or other liabilities of any nature resulting from the user's breach of this Agreement.
6.3 Release. YourTicketMarket are not involved in the actual transactions that occur between purchasers and sellers. YourTicketMarket is not liable to the buyer or seller for the acts or omissions of the other.
6.4 Liability. YourTicketMarket accept liability for any losses the user suffers in relation to a purchase or sale of a ticket (or tickets) only up to a maximum amount of the price of the ticket(s) (including any VAT). YourTicketMarket will not be responsible for any indirect losses or loss of profits.
6.5 Force Majeure. YourTicketMarket will not be liable for any breach of this agreement arising out of circumstances beyond YourTicketMarket's reasonable control including but not limited to any act of God, natural disaster, act of terrorism, failure of third parties to provide necessary or desirable services, failure of infrastructure or power supplies, denial of service or similar attacks on the Website or YourTicketMarket's systems or other reasons causing service outages.
7. Warranties
7.1 True information. The user represents and warrants that all the information the user has submitted to YourTicketMarket in the user’s registration or order is true, accurate and complete.
7.2 Legal Compliance. The user represents and warrants that he or she is 18 or over and able to enter into legally binding contracts and that during any interaction with the Website the user will comply with all applicable law.
8. Information
8.1 Copyright. The Website, including without limitation all data (or compilations of data) text, graphics, logos, buttons, images, audio clips, and computer programs on or incorporated on it, are the property of YourTicketMarket or its suppliers, and are protected by copyright, trademark and other intellectual property laws. Any unauthorised reproduction, modification, distribution, transmission, republication, display, or performance of the software or the content on the Website is strictly prohibited.
8.2 Linking to the Website. YourTicketMarket expressly prohibits linking by other sites to any part of this Website other than the home page (so-called “deep-linking”) except where YourTicketMarket has otherwise expressly given permission. In addition, YourTicketMarket expressly prohibits the linking to the home page of this Website in such a manner that suggests or could be understood to imply that any part of this Website is part of another web site and, in particular, third parties must not frame or use other techniques to enclose any part of this Website.
8.3 Third Party Information. YourTicketMarket do not check the accuracy or veracity of information provided by the sellers which is made available through the Website. By using this Website, the user agrees that YourTicketMarket are not responsible for the acts or omissions of users on the Website except as related to YourTicketMarket’s guarantee on the user’s ticket purchase after a purchase has been confirmed.
9. Other Terms
9.1 Set Off. The user agrees that YourTicketMarket can set off any amount the user owes YourTicketMarket against any monies held by or owed to the user by YourTicketMarket at any time.
9.2 Law and Jurisdiction.These terms and conditions are governed by the laws of England and Wales. The user and YourTicketMarket agree to submit to the non exclusive jurisdiction of the English Courts.
9.3 Notices.Except as expressly stated otherwise, all notices to the user shall be sent to the email address the user provided to YourTicketMarket during the registration process. Such notice shall be deemed given one business day after the email is sent.
